Consumer Protection Bill California AB 2762 Signed into Law
The Environmental Working Group and the Personal Care Products Council Work Together to Protect Public Health

Washington, D.C. – The Environmental Working Group (EWG) and the Personal Care Products Council (PCPC) applaud Governor Newsom for signing into law California Assembly Bill 2762 (AB 2762), which prohibits the sale and manufacturer of cosmetics and personal care products with certain ingredients in California. This landmark bill moves the industry one step closer to global regulatory alignment.

“Californians now have greater assurance of the safety of the consumer products they use every day, like lotion and body wash, toothpaste, shampoo and conditioner, and makeup,” said EWG President Ken Cook. “This marks a momentous milestone in the history of cosmetics and personal care products regulation. And for the first time, groups like EWG along with a diverse group of stakeholders and the industry’s trade association, the Personal Care Products Council, support legislation to modernize the rules governing these products.”

California is the first state to limit the use of these ingredients from all cosmetics and personal care products such as moisturizers, hand sanitizers, body washes and other essential products used every day. The 12 ingredients are already prohibited from cosmetics and other personal care products sold in the European Union and other countries.

“We are pleased to have joined efforts with EWG and many other organizations on this important piece of legislation,” said PCPC President & CEO Lezlee Westine. “Californians deserve a law that provides consumers with continued confidence in the products they use and trust every day. We all agree that this bill helps protect public health in California while safeguarding the jobs of the more than the 415,000 Californians who work for the overall personal care industry and the more than $28 billion contributed to the state’s economy.”

The law was coauthored by Assembly Members Al Muratsuchi (D-Torrance), Bill Quirk (D-Hayward) and Buffy Wicks (D-Oakland). Black Women for Wellness, Breast Cancer Prevention Partners, CalPIRG and EWG were co-sponsors, and other public health, environmental, consumer protection, and faith-based organizations were integral to this joint effort. Statement by the Personal Care Products Council on California SB 312 – Industry Has Long Supported Transparency

Washington, D.C. – “The Personal Care Products Council (PCPC) and its member companies support the legislative intent of SB 312, which mandates specific fragrance ingredient disclosure for beauty and personal care products. We are pleased that today Governor Newsom signed this important piece of legislation into law. PCPC has long supported the voluntary disclosure of allergens in cosmetics and personal care products, and this legislation is largely consistent with our long-standing position.

“We also support additional transparency for fragrance and flavor ingredients in cosmetics and personal care products. In fact, many of our member companies voluntarily enhance their transparency efforts and provide fragrance information directly to consumers vis a vis their websites and other educational materials. We believe people have the right to know about – and a right to understand – the ingredients used in their products so they can make informed purchasing decisions.

“It is unfortunate, however, that Section 2 of the bill includes misleading declarations and misrepresents our industry. We support the legislation’s intent to provide consumers more access to information, but we fundamentally disagree with the implication that fragrance ingredients in cosmetics are not safe. As a result, we are unable to fully support the bill as written and have taken a neutral position.

Statement by the Personal Care Products Council on Federal Legislation, Creating a Respectful and Open World for Natural Hair (CROWN) Act

Washington, D.C. – “The Personal Care Products Council (PCPC) applauds the U.S. House of Representatives’ passage of the Creating a Respectful and Open World for Natural Hair (CROWN) Act. The CROWN Act seeks to prevent discrimination based on characteristics such as hair texture and cultural styles, particularly those common in the Black community. It specifically recognizes that Black individuals are disparately impacted and excluded from some workplaces based on hair discrimination. As such, the CROWN Act amends definitions of ‘race’ to include those traits historically associated with race, such as hair texture and protective hairstyles like ‘braids, locks and twists.’ 

“With a deep-rooted commitment to diversity, PCPC has long supported the CROWN Coalition’s mission to advance anti-discrimination legislation across the United States and actively supported passage of similar legislation in seven states. While industry has made progress, we know there is more work to do to address diversity.

“Legislation such as the CROWN Act creates a clear link between natural hair and race, and broadens the scope of protections to prevent more subtle forms of bias that may be found in the workplace. Grooming and dress are an important part of society and should be fully embraced and respected.”
