The New CPSC Safety Database: How Will It Affect You?

In early March the Consumer Product Safety Commission (CPSC) went public with its product safety database. Almost anyone will be permitted to submit a report of harm (safety report) about any product subject to CPSC's jurisdiction. While CPSC jurisdiction over cosmetics and OTCs is limited to that provided under Poison Prevention Packaging Act, first indications are that the CPSC intends to interpret its jurisdiction liberally. In implementing the database, the CPSC has put the emphasis on receiving reports--not investigating and resolving them. There are also fears that, in its present form, the database can be manipulated by competitors and third parties like private plaintiff's attorneys. CPSC, FTC, states’ attorneys general, and private plaintiffs may also use the database to bring investigations and litigation, despite serious accuracy problems. To reduce regulatory and product liability risks, clients need to act proactively.
